TANSU INSTANT WIN GAME AND SWEEPSTAKES OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

  1. Eligibility. The Tansu Instant Win Game and Sweepstakes (the “Promotion”) is open to all legal residents of the fifty (50) United States and D.C. who are at least 18 years old at time of entry, except employees and officers of ASICS America Corporation, its respective parent or affiliated companies, subsidiaries, retailers, dealers, sales representatives, distributors, advertising agencies, promotional and prize suppliers and the immediate families (parent, child, sibling and spouse of each) and household members of each. VOID WHERE PROHIBITED.
  2. How the Promotion Works. The Promotion consists of an Instant Win Game (“Game”) and a Sweepstakes comprised of four (4) random drawings (“Sweepstakes”). The Game starts at 12:00 A.M. Eastern Time (“ET”) on March 17, 2010 and ends at 11:59 P.M. ET on August 15, 2010, or when all Game prizes have been awarded, whichever is earlier
  3. The first Sweepstakes Period starts at 12:00 A.M. ET on [March 17, 2010] and ends at 11:59 P.M. ET on [May 19, 2010]; the second Sweepstakes Period starts at 12:00 A.M. ET on [May 20, 2010] and ends at 11:59 P.M. ET on July 23, 2010 the third Sweepstakes Period starts at 12:00 A.M. ET on [July 24, 2010] and ends at 11:59 P.M. ET on [September 27, 2010]; and the fourth Sweepstakes Period starts at 12:00 A.M. ET on [September 28, 2010] and ends at 11:59 P.M. ET on [December 1, 2010]. The relevant dates of the four (4) drawings are listed in the table in Section 4 below.
  4. The Game
    1. How to Get Game Cards. Attend Onitsuka Tiger-related consumer events during SXSW (March 18-20 2010), WMC (March 23-27 2010), Coachella (April 17-18 2010), Bonnaroo (June 10-13 2010), or Outsidelands (August 13-15 2010) (each, an “Event”) and obtain a scratch off card from an Onitsuka Tiger representative. Game cards are available while supplies last. LIMIT ONE (1) GAME CARD PER PERSON PER EVENT.
    2. How to Play. The object of the game is to determine which of the three (3) different prizes being offered will be redeemable with the card you have received. Scratch off the silver surface on the game card to reveal one (1) of the following three (3) prizes: Onitsuka Tiger sneakers (door #1), Onitsuka Tiger t-shirt or hat (door #2), or Onitsuka Tiger necklace (door #3). The prize that is named on the game card is the cardholder’s prize. To redeem your prize, visit the Onitsuka Tiger Tansu display at the Event. All prizes must be redeemed at the Event.
    3. Game Prizes: Up to 200 pairs of Onitsuka Tiger sneakers will be awarded (Approximate Retail Value (“ARV”): $100 each. Up to 1,800 Onitsuka Tiger hats or t-shirts will be awarded (ARV: $9-$18 each). Up to 15,000 ASICS Onitsuka Tiger necklaces will be awarded (ARV: $10 each). All properly claimed prizes will be awarded. To claim a prize, winners will be required to visit the Onitsuka Tiger booth at the Event, present the Game Card to an Onitsuka Tiger representative and execute and return an Affidavit of Eligibility/Liability Release and, where lawful, a Publicity Release (collectively, the “Prize Claim Documents”) or prize may be forfeited. LIMIT ONE (1) GAME PRIZE PER PERSON PER EVENT. Odds. Odds of receiving the Onitsuka Tiger sneakers game card: 1:85. Odds of receiving the ASICS t-shirt/hat game card: 1:9. Odds of receiving the Onitsuka Tiger necklace game card: 1:1.3.
  5. The Sweepstakes
    1. How to Enter the Sweepstakes. During each Sweepstakes period, visit the website www.OTsweepstakes.com (the “Website”) and follow the instructions for entering the Sweepstakes. Upon completion and submission of the entry form, you will automatically be entered. All required information on the entry form must be completed to enter and to be eligible to win. Online entry into the Sweepstakes must be made by the entrant, only at the Website. Entries made by any other individual or any entity, and/or originating at any other website or e-mail address, including, but not limited to, commercial sweepstakes subscription notification and/or entering service sites, will be declared invalid and disqualified for this Sweepstakes. Proof of entering information at the Website is not considered proof of delivery to or receipt by Sponsor of such entry. The Website’s database clock will be the official timekeeper for all Sweepstakes entries. LIMIT ONE (1) ENTRY PER SWEEPSTAKES PERIOD PER PERSON.
    2. Sweepstakes Prizes/Odds. For the Sweepstake, a total of Two hundred (200) prizes consisting of one (1) pair of Onitsuka Tiger sneakers. ARV: $100 each. Actual odds of winning depend on the number of eligible entries received during each Sweepstake Period. LIMIT ONE (1) SWEEPSTAKES PRIZE PER ENTRANT.
    3. Winner Selection and Notification. On each of the following four (4) dates, fifty (50) potential prize winners will be randomly selected in a drawing from among all eligible entries received during the corresponding Sweepstakes Period:

    The potential prize winners will be notified by email or mail using the contact information provided at the time of entry. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by a potential winner for any reason. Within five (5) days of the date notice/attempted notice is given (the “Notification Period”), the potential prize winner will be required to execute and return to Sponsor the Prize Claim Documents. If, despite Sponsor’s reasonable efforts, a potential prize winner cannot be contacted or fails to sign and return the Prize Claim Documents during the Notification Period, such potential prize winner will forfeit his or her prize, and an alternate winner may be selected by random drawing from among all remaining eligible entries received during the Sweepstakes period. A potential prize winner will also be disqualified from the Sweepstakes, and an alternate winner may be selected, if he/she is found to be ineligible, has not complied with these Official Rules or declines the prize for any reason prior to award. Sponsor will conduct no more than three (3) alternate drawings for each Sweepstakes period, after which the Prize will not be awarded. In the event of a dispute as to the identity of a winner based on an email address, the authorized account holder of the email address submitted at time of entry will be declared to have made the winning entry.
  6. General Conditions. By participating in this Promotion, entrants agree to these Official Rules, which are final and binding in all respects. No cash equivalent or substitution of prize is offered, except at the sole discretion of the Sponsor. No transfer of prize. Any portion of the prize not used will be forfeited. All expenses on receipt and use of prize and any federal, state and local taxes on the prize are the responsibility of the winner. All game pieces are subject to verification and are void if they are not obtained in accordance with these Official Rules and through legitimate channels; if any game piece or part of a game piece is counterfeit, altered, defective, illegible, reproduced, tampered with, mutilated or irregular in any way or if game pieces contain printing, typographical, mechanical, seeding or other errors. Sponsor’s liability for game pieces containing printing or other errors is limited to replacement of such game piece with another eligible game piece, while supplies last. If more prizes are claimed than intended to be awarded due to a computer programming, printing, production or other error, such prizes will be awarded in a random drawing from among all claims received for such prize. In no event will Sponsor be liable for more than the stated number of prizes above. If the potential Prize winner is a minor in his/her state of residence, Sponsor reserves the right, in its sole discretion, to award the applicable prize either in the name of the parent or legal guardian of such minor winner, or the parent or legal guardian of such minor winner will be required to ratify and sign Prize Claim Documents. Sponsor reserves the right, in its sole discretion, to modify, cancel, terminate or suspend this Promotion, or any portion of the Promotion, at any time, without notice if it determines that the administration, fairness, security or proper operation of the Promotion is being or has been corrupted and/or tampered with and, in such situation, to select the winners using all known eligible non-suspect prize claims received as of the date of termination in a manner deemed fair and appropriate by Sponsor. Sponsor reserves the right to disqualify any individual who tampers with, cheats, deceives, or otherwise engages in unfair practices concerning the administration and operation of the Promotion or intends to annoy, abuse, threaten or harass any other entrant or Sponsor. Unclaimed prizes will not be awarded. Any attempt by an entrant to undermine the legitimate operation of the Promotion is a violation of criminal and civil laws, and should such an attempt be made, Sponsors reserve the right to seek damages from any such entrant to the fullest extent permitted by law.
  7. Limitations of Liability and Release: Sponsor is not responsible for lost, late or misdirected entries, any typographical errors in the offer or administration of the Promotion, including, but not limited to, errors in the advertising, these Official Rules and the distribution of the prizes, incorrect or inaccurate entry of information, human error, technical malfunction, lost/delayed data transmission, omission, interruption, deletion, defect, line failure of any telephone, computer or other network, computer equipment, software or any combination thereof, inability to access the Website, problems uploading or downloading any Sweepstakes-related materials from the Website, late, lost, damages, misdirected, incorrect or incomplete entries or errors in any Promotion-related materials or these Official Rules. Prizes are awarded “AS IS”. Sponsor has not made and/or is not responsible for any misrepresentation or guaranty, express or implied, in fact or in law, concerning the prizes. As a condition of participating in the Promotion, the entrant releases Sponsor from any and all claims, damages or liabilities arising from or relating to such entrant’s participation in the Promotion. By accepting a prize, recipient agrees that the Sponsor and all of its respective officers, directors, employees, representatives and agents will have no liability whatsoever for, and shall be held harmless by winner against, any liability for injuries, losses or damages of any kind to persons or property resulting in whole or in part, directly or indirectly, from participation in the Promotion, or the acceptance, possession, use or misuse of any prize. By accepting the prize, winner grants to Sponsor and those acting under its authority the right to use his/her name, likeness, hometown and biographical information, for any lawful purpose (including but not limited to advertising and promotion), in perpetuity, in any media now known or hereafter developed, without further permission or compensation, except where prohibited by law.
  8. Governing Law. This Sweepstakes is offered only in the United States and is governed by, and construed in accordance with, the laws of the state of California without regard to conflicts of law principles. Entrants consent to the jurisdiction and venue of the federal or state courts located in Orange County, California for the resolution of any claims.
  9. Winners List Request: For a copy of the Winners List for the Sweepstakes, send a self-addressed, stamped envelope postmarked by 12/31/2010, which must be received by 1/10/2011 to: Onitsuka Tiger Tansu Scratch-Off Sweepstakes Winners List Request, ASICS America Corporation, Attn: Direct Marketing, 29 Parker, Suite 100, Irvine, CA 92618. Vermont residents may omit return postage.
